The Workers' Compensation System

By law, employers are required to carry workers' compensation insurance. Employers must immediately provide workers' compensation benefits if you are injured at work. However, some employers either do not carry workers' compensation insurance in violation of the law, or their insurance company deems that you have recovered, and discontinues benefits prematurely. Mr. Crane will assist you in receiving the benefits to which you are entitled.

Permanent Partial Disability

Almost every injury leaves you with some residual affect. Your right to benefits does not end simply because the worker’s compensation doctor ends your treatment and sends you back to work. You may be entitled to further treatment and further temporary disability. Even if you are no longer entitled to any further treatment or disability, you are always entitled to a settlement for the disability and impairment you have suffered. The worker’s compensation insurance carriers often do not tell you this. Mr. Crane will ensure that you receive all benefits to which you are entitled as well as your final settlement.

Auto Accidents

New Jersey is a “no fault” state as it relates to auto accidents.  Your own insurance carrier is to cover your injuries that you suffer in the accident under “personal injury protection” which is known as PIP.  PIP has its own set of rules and regulations and this is what you must deal with in regard to your treatment and the payment of your medical bills.  If you are cut off from treatment or are not receiving the proper treatment contact Mr. Crane for assistance.

Ununinsured Motorist Accidents

If the person that hit you is uninsured or does not have enough insurance to cover your damages this is covered under your own policy under the uninsured/under insured motorist section.  Again, this comes with its own set of rules, regulations and statutes.  Mr. Crane is fully familiar with these areas and has represented numerous clients in arbitrations to obtain proper damages under this section of their insurance.

Gathering evidence:

It is extremely important that you contact Mr. Crane as soon as practicable after your accident.  The gathering of evidence, information and witness statements may be critical.  Waiting even a month can result in evidence disappearing or being destroyed.  When coming to your appointment with Mr. Crane be certain to bring your declarations page from your insurance policy, the incident or accident report, and any photographs of the damage to vehicles, property or your injuries, as well as a list of all of your medical providers with names, addresses, and phone numbers; this includes prescriptions for medications and the name and address of your pharmacy.

Notice and limitations periods:

It is also important to notify Mr. Crane of your accident as soon as possible due to the fact in various circumstances there are different limitation periods within which notice must be given to governmental entities etc.  Failure to meet these deadlines in certain circumstances may result in a full bar of your claim which means you will never be able to make a claim.  Therefore contact Mr. Crane as soon as possible to insure that the notice requirements of your specific incident are met.
